Terms of Service

1) Eligibility

You must be at least 18 years old and able to form a binding contract to use Comparion. The app is offered for use in South Africa, Nigeria, Kenya, Ghana and Tanzania. We make no claim that it is appropriate or available elsewhere, and you are responsible for compliance with local law.

2) What Comparion Is & Is Not

Comparion is a price comparison tool. It retrieves fare estimates that third-party ride providers publish or return for a trip you describe, presents them side by side, and — when you choose one — hands you off to that provider's own app or website to complete the booking.

Comparion is not: a transportation carrier, a transportation network company, a broker or agent of any provider, a payment processor, or a party to your ride. We do not set fares, guarantee availability, dispatch vehicles, vet drivers, or handle refunds, complaints, lost property, safety incidents or disputes arising from a trip. Those are matters between you and the provider.

Comparion charges you nothing and adds no fee, commission or markup to any fare you are quoted.

3) Fares Are Estimates

Fares shown in Comparion are estimates at the moment they are retrieved. Ride pricing is dynamic and changes with demand, traffic, route, vehicle availability, tolls, wait time, tips, promotions and provider policy. The amount you are ultimately charged is determined solely by the provider you book with and may differ from what Comparion displayed.

Where you connect an account, Comparion attempts to reflect pricing specific to you, including membership discounts a provider applies. We cannot guarantee that such pricing is complete or current, and any discount, promotion or credit remains subject to the provider's own terms.

Comparisons may be incomplete. A provider may be unavailable, may not serve your route, may not return a price, or may be temporarily excluded. Absence from a comparison is not a statement about that provider.

4) Account Connections & Third-Party Services

Some providers require you to connect an account before personalized fares can be retrieved. Connecting is optional; Comparion is usable without it.

When you connect an account, you authorize Comparion to access that account solely to retrieve fare and trip information for comparisons you request. Access credentials and tokens are stored in encrypted storage on your device. You may disconnect any provider at any time in Settings, which deletes the stored credential from your device.

You are responsible for complying with each provider's own terms of service. Your use of a provider's app, website or service is governed by their agreement with you, not this one. A provider may change, restrict or terminate access at any time, which may cause a comparison to become unavailable.

You must only connect accounts that belong to you and that you are authorized to use.

5) No Affiliation & Trademarks

Comparion is independent and is not affiliated with, endorsed by, sponsored by, or in any partnership with Bolt, inDrive, Uber, Yango or any other provider.

Provider names and marks are the property of their respective owners and are used solely for nominative purposes — to identify which service a fare belongs to. No claim of ownership, endorsement or association is made or implied.

6) Acceptable Use

You agree not to:

• Use Comparion for any unlawful purpose, or in violation of any provider's terms;
• Connect an account you do not own or are not authorized to use;
• Reverse engineer, decompile, or attempt to extract source code from the app, except where such restriction is prohibited by law;
• Scrape, resell, redistribute or commercially exploit fare data obtained through Comparion;
• Interfere with, overload, or attempt to gain unauthorized access to Comparion's systems or those of any provider;
• Use automated means to access the app beyond its intended personal use;
• Misrepresent your identity, or use Comparion to facilitate fraud against any provider.

We may suspend or terminate access for conduct that violates these Terms or that we reasonably believe harms Comparion, a provider, or another user.

7) Intellectual Property

Comparion, its software, design, and content are owned by us and protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. No other rights are granted.

8) Disclaimers

COMPARION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT FARE ESTIMATES ARE ACCURATE, COMPLETE, OR CURRENT; THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE; OR THAT ANY PROVIDER WILL BE AVAILABLE. WE MAKE NO WARRANTY REGARDING THE CONDUCT, SAFETY, QUALITY OR LEGALITY OF ANY PROVIDER, DRIVER OR VEHICLE.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

9) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COMPARION AND ITS OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

WITHOUT LIMITING THE ABOVE, WE ARE NOT LIABLE FOR: any difference between a displayed estimate and the amount a provider charges you; any act or omission of a provider, driver or vehicle, including personal injury, property damage, delay, cancellation or non-arrival; or any provider's suspension of access.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

10) Indemnification

You agree to indemnify and hold harmless Comparion from any claim, demand, loss or expense (including reasonable legal fees) arising out of your misuse of the app, your violation of these Terms, your violation of any provider's terms, or your infringement of any third party's rights.

11) Governing Law, Arbitration & Class Action Waiver

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Informal resolution first. Before starting arbitration, please contact us at support@comparion.com and give us 30 days to try to resolve the issue.

Binding arbitration. Any dispute not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring a qualifying claim in small claims court.

Class action waiver. YOU AND COMPARION EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. Claims may be brought only in an individual capacity.

Opt out. You may reject this arbitration agreement by emailing support@comparion.com within 30 days of first accepting these Terms, stating your name and intent to opt out. Opting out does not affect any other part of these Terms.

12) Changes & Termination

We may update these Terms. Material changes will be posted here with an updated date and, where appropriate, notified in the app. Continued use after a change means you accept it.

You may stop using Comparion at any time by uninstalling the app, which removes any locally stored provider credentials. We may suspend or discontinue the app, in whole or in part, at any time.
